Justice Ashwani Kumar Mishra passed this order while extending the petition of Prabhat Kumar Verma and 53 others. These petitions were filed against arbitrary appointment for the recruitment of 29334 science and mathematics assistant teachers on July 11, 2013.
It is a qualification to have TET pass with Science Mathematics or Mathematics subject in the Senior Basic Schools by the Uttar Pradesh Basic Education Council. He said that the same TET could sit in the examination, who could qualify for appointment as assistant teacher. But those who took the first year's training took the exam and they were given appointment if they were successful.
The court said that under the rules 1981, students of the last year of training in the TET or those who are trained can sit only. Both of these questions are factual. Therefore, firstly make BSA decisions in this respect.
It was said that those who have not graduated in science or mathematics subjects and who are not trained or are not in the last year of training, they were given appointment. The petition was challenged by accusing BSA of appointing people without qualification and qualification.
